General Terms and Conditions of Service and Contracting

Welcome to the Can Vivot website! Before contracting our services, please read these General Conditions carefully. By using our website and purchasing our products, you confirm that you have read, understood, and accepted these terms.

 

  1. Purpose and Scope of Application

This document sets out the General Terms and Conditions of Contracting and Service applicable to the purchase of tickets for guided tours of the Can Vivot Palace Museum through our website https://canvivot.es/.

Our service is aimed at individuals and consumers located in Spain, the European Union, and other countries. The contracting of our services implies acceptance of these terms, which are governed by Spanish legislation, in particular Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSI-CE), and Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws. We also ensure compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016 (GDPR), and Organic Law 3/2018, of December 5, on the Protection of Personal Data and the Guarantee of Digital Rights (LOPDGDD).

  1. Description of the Service

Through our website, we offer the possibility to purchase tickets for in-person guided tours of the Can Vivot Palace Museum. The tours take place on the dates and times specified during the purchase process and are designed to offer a cultural and educational experience about the history and heritage of the Palace. We do not offer physical product shipments, digital downloads, or online services other than the management and reservation of the guided visit itself. However, for those who wish, we offer an audio guide accessible via a QR code which you can open on your mobile phone.

 

  1. Contracting Process
    1. Service Selection: The user selects the desired date, time, and number of tickets for the guided tour through the website interface.
    2. Required Information: To complete the purchase, the user must provide their full name, a phone number, and an email address. It is not necessary to create an account or register on the website to complete the purchase.
    3. Review and Confirmation: Before proceeding to payment, the user will have the opportunity to review a summary of their order, including the selected tickets, date, time, and total price.
    4. Acceptance of Terms: By clicking the “Buy” button or equivalent, the user explicitly declares their acceptance of these General Conditions, the Privacy Policy, and the Legal Notice.
    5. Purchase Confirmation: Once payment has been successfully processed, the user will receive a purchase confirmation by email to the address provided, which will serve as proof of reservation. This confirmation will include the tour details and purchased tickets.

 

  1. Prices and Payment Methods

The prices for the guided tours are shown on our website in Euros (€) and include applicable taxes.

The following secure payment methods are available:

    • Bizum
    • Bank transfer (bank details will be provided during the purchase process)
    • Credit/debit card (Visa, MasterCard, etc.)

Payment must be made in full at the time of contracting the service.

 

  1. Cancellation Policy, Modifications, and Right of Withdrawal

Given the nature of our service (purchase of tickets for a guided tour on a specific date and time), we inform you that, according to Article 103 l) of Royal Legislative Decree 1/2007, of November 16, the right of withdrawal does not apply to contracts for accommodation, transport, catering, or leisure activities that are scheduled for a specific date or period.

However, the following cancellation and modification conditions apply:

    • User cancellations: Cancellations made at least 1 day in advance of the visit date may be eligible for a full refund.
    • User modifications: Changes to date or time are subject to availability and must be requested at least 1 day in advance of the visit.
    • Cancellations by Can Vivot: If Can Vivot is forced to cancel a guided visit due to force majeure or circumstances beyond its control, the user will be offered the option to reschedule the visit or receive a full refund.

  1. Liability

Can Vivot commits to providing the guided tour service with the utmost diligence and professionalism. However, we are not responsible for:

    • Damages resulting from misuse of the website or incorrect information provided by the user.
    • Interruptions or errors in website service due to force majeure or beyond our control.
    • Any incidents occurring during the guided visit not directly attributable to negligence by Can Vivot or its staff.

 

  1. Personal Data Protection

In compliance with the GDPR and LOPDGDD, we inform you that the personal data you provide during the purchase process (name, phone number, and email address) will be incorporated into a file owned by Can Vivot solely for the purpose of managing your reservation, providing the guided tour service, and, if applicable, sending you communications related to the contracted service.

The legal basis for the processing of your data is the execution of the contractual relationship. Your data will be kept for the time necessary to fulfill the purpose for which they were collected and to determine any potential liabilities arising from that purpose and data processing.

  1. Intellectual Property

  1. Modification of the General Conditions

Can Vivot reserves the right to modify these General Conditions at any time to adapt them to legislative or jurisprudential developments or market practices. Such modifications shall take effect upon publication on the website. Continued use of the website and contracting of services by the user after such publication shall constitute acceptance.

 

  1. Applicable Law and Jurisdiction

These General Conditions shall be governed by and interpreted in accordance with Spanish law. Any disputes arising from the interpretation or execution of these Conditions shall be submitted, with express waiver of any other jurisdiction, to the Courts and Tribunals of Palma de Mallorca.

In the case of contracting with consumers, the provisions of current consumer legislation shall apply, which includes the possibility of resorting to online dispute resolution through the European Commission’s Online Dispute Resolution Platform, available at: https://ec.europa.eu/consumers/odr/.
